Ricardo Tosto on the History of Brazilian Electoral Courts

Ricardo Tosto on the History of Brazilian Electoral Courts

The Brazilian Electoral Justice system has its roots in the late 1920s, when a movement for fairer elections sprung up all over the country. The Electoral Justice System was established in 1932 and disbanded in 1937 during the dictatorship of Getulio Vargas. The court system was then re-established in 1945 at the end of World War II.

One of the main developments in the re-establishment of the electoral courts in 1945 was the requirement that all candidates have a party affiliation. Over time the electoral just system has come to encompass a network of federal and state electoral courts, which are staffed by judges on loan from other courts. The Superior Electoral Tribunal is located in Brasilia and there are state courts for each Brazilian state and for Brasilia, the country’s federal district.

In addition, each electoral zone, which is made up of several voting precincts, is presided over by a trial judge, who has jurisdiction over elections matters arising in that zone. Appeals can then proceed to the Regional Tribunal or if necessary to the federal court in Brasilia. At the end of 2016, Brazil’s electoral courts had a little over 5,000 cases pending.
